1.當盈豐維修工程有限公司("盈豐維修工程")接受在維修單上所列的機器和/或有關配件進行檢驗、維修(包括更換零件)或其他服務("統稱"服務")，盈豐維修工程承諾依據以下條款及條件提供服務。除非以書面形式另行指定，本條款及條件將被載入維修單，並構成其中的一部分。維修單應是盈豐維修工程與客戶之間合法及有效的合同。
2.除非機器在盈豐維修工程承認的有效保用協議("有效保用")的包括範圍內，盈豐維修工程有權根據本條款第七和第八條向客戶索取檢驗費和維修費。該有效保用須在提交機器予盈豐維修工程檢查時，以出示相關保用協議/保用證作證明。若未能證明，盈豐維修工程有絕對酌情決定權，在猶如機器沒有有效保用的情況下提供服務。
3.即使出示有效保用，若機器經盈豐維修工程檢驗後認為不適宜維修，盈豐維修工程保留退還該未維修的機器和零件的權利。
4.盈豐維修工程真誠接受機器以提供服務，任何刮痕或損壞，不論該刮痕或損壞在盈豐維修工程收到機器之前已存在或在運送或服務過程中引起，盈豐維修工程一概不負責，除非客戶能充分證明該刮痕或損壞是由盈豐維修工程的嚴重疏忽而引起。
5.經服務後的機器若功能或表現轉差，盈豐維修工程一概不負責，除非客戶能充分證明該轉差是由盈豐維修工程的嚴重疏忽而引起。
6.除在有效保用適用的情況下(但受本條款及條件的第二和第三條所限制)，盈豐維修工程有權在機器送交服務時索取檢驗費(該費用由盈豐維修工程有絕對酌情決定權)，不論 1.)機器最後是否可作維修；2.)客戶其後是否接受服務(以下界定)。該檢驗費不可償還，但可從其後在客戶同意維修機器的情況下索取之維修費(不包括配件購買價錢)扣除。
7.盈豐維修工程須在檢驗機器後以電話、傳真或電郵通知客戶 1.)機器是否適宜進行服務，和 2.)維修費用 ("估計費用")。在符合本條款第九條的情況下，若客戶口頭或書面向盈豐維修工程確定以估計費用維修機器 ("客戶確定")，盈豐維修工程須提供服務。客戶確定應構成盈豐維修工程以估計費用提供服務的明確接受。
8.一旦客戶決定訂購零件作維修或購買用途，客戶須在盈豐維修工程提供服務前根據本條款第 12 條預先支付款項作為訂金(該款項之金額由盈豐維修工程有獨有及絕對酌情決定權)("訂金")。訂金不設退回，客戶可享有一年使用期，以支付下一次的檢查費或維修費。
9.盈豐維修工程恕不負責清潔或維修任何水龍頭、水管、電線、電源掣、櫃門和拆門等，除非客戶以書面聲明完全承擔就該清潔或維修工作而引起的風險。盈豐維修工程有權就該清潔或維修工作索取額外費用。盈豐維修工程將不負責任何因此而引起的缺陷、轉差或損壞。
10.所有在提供服務時更換之零件為盈豐維修工程之財產所有。
11.一旦客戶在給予客戶確定後要求盈豐維修工程停止提供進一步服務，盈豐維修工程有絕對酌情決定權，向客戶索取未收到要求之前已完成的服務之合理費用。
12.客戶須在客戶確定的日期七天之內支付訂金。維修費餘額和任何相關的額外費用(如有的話)(統稱"餘額")須在客戶收到盈豐維修工程的口頭或書面交還機器通知時支付。
13.一旦客戶未能在收到交還通知後 1 個月內領取機器，除盈豐維修工程另有通知，機器將當作為沒收，盈豐維修工程並有權在無須再作通知的情況下以適當的方式處置機器，並向客戶討回尚欠的維修費或任何由處置或處理機器而引起的費用。盈豐維修工程在任何情況下不須對行使其權力負責。
14.在符合本條款第 15 和 16 條的情況下，並在有效保用並不涵蓋本維修單中提及的維修項目及客戶就維修項目已支付相關檢查及維修費用的前提下，盈豐維修工程須從交還機器之日期起提供*保養期("保養")(參考備註頁)。
15.保養期內涵蓋範圍只限於 1.)盈豐維修工程接受服務機器時鑑定的缺陷和；2.)列在本維修單上的缺陷，並須視乎盈豐維修工程是否擁有維修該缺陷的零件。若盈豐維修工程認為機器曾經被錯誤操作、損壞、改裝、受潮受濕而引致損壞、或經未經盈豐維修工程或製造商授權之人員修理或改裝，保證將失效。
16. 保養不包括︰例行清潔、正常表面及機件、水龍頭、水管、電線、電源掣、擺放機器的櫃身及櫃門。
17.假如盈豐維修工程因無法合理控制或不能以合理努力避免的情況，如天災、內亂、暴動、戰爭、任何意外、恐怖活動或其他不可預見的情況而 1.)引起任何損失；2.)不遵守或延遲履行責任，盈豐維修工程一概不負責。
18.機器將在客戶或該代表呈示維修單正本，並完全繳付盈豐維修工程有權索取的尚欠費用時交還給客戶。
19.盈豐維修工程所收集的任何個人資料，包括但不限於維修單內的資料和客戶或其代表的身份證副本的聯絡資料，只用於與機器檢驗和維修有關的用途。
20.本條款及條件有中文和英文版本。如中文版本與英文版本出現任何歧義，一概以英文版本為準。
21.在任何情況下，盈豐維修工程於提供服務之最高責任將不高於估計費用。客戶或任何第三者遭受的附帶或後果性損失，或生意或盈利或自用的虧損，盈豐維修工程一概不負責。
22.在任何情況下，盈豐維修工程所提供的檢驗、維修或服務在維修技工離開現場後，客戶或任何第三者遭受的附帶或後果性損失，或生意或盈利或自用的虧損，盈豐維修工程一概不負責。
23.本維修單各條條文的執行互相獨立，若任何條款無效均不影響其他條款的有效性。如任何條款因含有某些條文或其提及的數量或時間長短(如適用)而變得失效，則該等條文應視為被刪除或已被做出適當的更改，以確保條款的有效性。
24.本維修單受香港法律管轄，並按其解釋。客戶及盈豐維修工程得受香港法院的非專屬司法管轄權管轄。
備註：
1. 上門費用並不包括維修人工、零件、運輸及回廠費用等，額外費用另行計算。
2. 每次服務完結時，請以現金即時交付給盈豐維修之服務人員，一般情況下收據會同時發出。
3. 離島、禁區及偏遠地點之上門服務，需要較長時間安排及客戶須付有關附加費。過於偏遠之地點可能未能提供上門服務。
4. 愉景灣客戶須支付愉景灣隧道及道路使用費。
5. 維修更換之零件，由維修完成日起計將享有 30 至 180 天保用期。
6. 如需要多於一位師傅搬走機器進行維修，需收取額外附加費 250 元（包括掛牆，疊機，插針位）。
7. 如客人安排進行維修的地方是在船隻上，將會收取額外交通附加費 500元。

1.When the Machine(s) and/or its/their related accessories as listed on the repair order are accepted by Ying Fung Maintenance Engineering Ltd. ("YING FUNG") for examination, repair (which includes replacement of any parts thereof) or the carrying out of any other work in connection with the Machine(s) (collectively referred to as "Services"), YING FUNG undertakes to provide the Services on the terms and conditions contained herein. Unless otherwise specified in writing, these terms and conditions shall be incorporated into the repair order and form part thereof. The repair order shall be a legal and valid contract between YING FUNG and the Customer.
2.YING FUNG shall charge the Customer an examination fee and a repair fee in accordance with Clause 7 and Clause 8, unless the Machine(s) are covered by a valid warranty agreement ("Valid Warranty") acceptable to YING FUNG. Such Valid Warranty shall be evidenced by the production of the original relevant warranty record/invoice for inspection at the time when the Machine(s) are tendered to YING FUNG for Services, failing which YING FUNG may, at its absolute discretion, carry out the Services as if the Machine(s) were not covered by any Valid Warranty.
3.Notwithstanding the production of a Valid Warranty, YING FUNG reserves the right to return the Machine(s) and part(s) un-repaired if such Machine(s) are, in the opinion of YING FUNG, unserviceable on examination.
4.YING FUNG accepts the Machine(s) for Services in good faith and shall not be held liable for any scratches or defacing whatsoever irrespective of whether such scratches or defacing exist prior to the receipt of the Machine(s) by YING FUNG or result during the course of transportation and/or Services unless it is proved by the Customer to the satisfaction of YING FUNG that the scratches or defacing are solely attributable to the gross negligence of YING FUNG.
5.YING FUNG shall not be held liable for any deterioration of condition, function or performance of the Machine(s) after the provision of Services unless it is proved by the Customer to the satisfaction of YING FUNG that the deterioration is solely attributable to the gross negligence of YING FUNG
6.YING FUNG shall be entitled to charge the Customer an examination fee (the amount of which to be determined by YING FUNG at its absolute discretion) at the time when the Machine(s) are deposited for the provision of Services (unless the Valid Warranty applies, subject however to Clause 2 and Clause 3), irrespective of (1.) whether the Machine(s) are eventually found to be serviceable or (2.) the Customer's subsequent Acceptance of Services (as defined below). Such examination fee is non-refundable but shall be deducted from the subsequent repair fee (which shall not include any price for purchase of accessories) to be charged to the Customer for such repairs in the event that the Customer agrees to have the Machine(s) repaired.
7.YING FUNG shall, after examination of the Machine(s), inform the Customer by telephone, fax or email as to (1) whether the Machine(s) are serviceable and if so, (2) the fee to be charged for the repairing work thereon ("Estimated Fee"). YING FUNG shall, subject to Clause 9, provide the Services in the event that the Customer confirms to YING FUNG, whether verbally or in writing, that the Machine(s) be repaired at the Estimated Fee ("Customer's Confirmation"). The Customer's Confirmation shall constitute unequivocal acceptance of the provision of Services by YING FUNG at the Estimated Fee ("Acceptance of Services").
8.In the event that the Estimated Fee exceeds HKD 1500, the Customer shall pay a deposit to YING FUNG (the amount of which shall be determined by YING FUNG at its sole and absolute discretion) for the Estimated Fee ("Deposit Payment") in advance in such manner as prescribed in Clause 13 before any Services are provided.
9.YING FUNG shall not be responsible for doing any cleaning or repairing of optical elements such as faucets, pipes, electrical cable, power plug, doors, cabinet doors and cabinet etc. In the course of provision of Services, unless the Customer agrees in writing that any such cleaning or repairing work shall be carried out by YING FUNG entirely at the Customer’s own risk. YING FUNG shall be entitled to charge additional fees in addition to the Estimated Fee for any cleaning or repairing work done in relation thereto. YING FUNG shall in no circumstances be held responsible for any defects, deterioration or damage arising therefrom or incidental.
10.All parts replaced during the provision of Services shall become the property of YING FUNG.
11.In the event that the Customer requests YING FUNG not to take any further steps for the provision of Services after giving the Customer's Confirmation, YING FUNG shall be entitled to charge the Customer for any Services done prior to YING FUNG's receipt of such request at such reasonable fee as may be determined by YING FUNG at its absolute discretion.
12.Deposit Payment shall be made within 7 days from the date of the Customer's Confirmation. The balance of the repair fee plus any additional fees charged to the Customer in connection therewith, if any, ("Balance Payment") shall be paid immediately upon the receipt of YING FUNG's notice (whether orally or in writing) of redelivery of the Machine(s) by the Customer.
13.The Customer shall collect the Machine(s) within one month from the date of verbal notification of redelivery given by YING FUNG. Unless otherwise notified by YING FUNG, the Machine(s) will be deemed to be forfeited by YING FUNG and YING FUNG shall have the right to dispose of the Machine(s) in whatever manner as YING FUNG considers appropriate without further notice, and to recover the outstanding repair fee or any fees and expenses incurred in disposing of or handling the Machine(s) from the Customer, in the event that the Customer fails to collect the Machine(s) within twelve months from the date of notification of redelivery. YING FUNG shall in no circumstances be held liable by reason of its exercise of the rights contained herein.
14.Subject to Clause 15 and 16, YING FUNG shall provide a Valid Warranty period ("Valid Warranty ")* such repairs as prescribed in this repair order are not covered by any Valid Warranty and the customer shall have paid the examination and repair fees for those repairs(*refer to page Remarks) .
15.The scope of the Valid Warranty shall only be limited to defects which are identical to those (1) identified upon acceptance of the Machine(s) for Services by YING FUNG and (2) listed on this repair order, and always be subject to the availability to YING FUNG of the relevant spare parts required for repairing such defects. The Guarantee shall not apply if YING FUNG is of the opinion (which shall be final and conclusive) that the Machine(s) have been misused, tampered, modified, liquid damaged, or repaired or examined without the authorization of YING FUNG or the manufacturer of the Machine(s).
16.The Valid Warranty does not cover: routine cleaning, normal cosmetic and mechanical wear, faucets, pipes, electrical cable, power plug, doors, cabinet doors and cabinet etc.
17.YING FUNG shall not be held liable for (1) any loss or damage or (2) failure or delay in performing any of its obligations contemplated hereunder due to events or circumstances caused by the act of God, civil commotion, riot, wars, any accidents, terrorist acts, or any other unforeseeable conditions which is beyond YING FUNG's reasonable control or which cannot be avoided by YING FUNG's exercise of reasonable diligence.
18.The Machine(s) shall be redelivered to the Customer or his/her representative on presentation of the original of this repair order and upon full settlement of all the outstanding fees to which YING FUNG is entitled to charge against the Customer.
19.Any personal data collected by YING FUNG including but not limited to the contact information contained in this repair order and the copy of the identity card of the Customer and his/her representative shall only be used for the purpose(s) relating to the examination and repairing of the Machine(s).
20.The terms herein are written in both Chinese and English. In case of any inconsistency or discrepancy between the Chinese and English versions, the English version shall prevail.
21.Notwithstanding anything contained herein, the liability of YING FUNG in respect of the provision of Services howsoever arising shall be limited to the amount of the Estimated Fee. In no event shall YING FUNG be liable to the Customer or any third party or personal use for incidental or consequential damages or any loss of business or profit.
22.Notwithstanding anything contained herein, the liability of YING FUNG in respect of the provision of Services or Inspection or Repair howsoever arising shall be ended after the technician left. In no event shall YING FUNG be liable to the Customer or any third party or personal use for incidental or consequential damages or any loss of business or profit.
23.The provisions contained in this repair order shall be enforceable independently of each of the others and the validity shall not be affected if any of the others is invalid. If any of the provisions is void but would be valid if some part of the provision is deleted, or if the amount or duration (if applicable) mentioned in the provisions was varied, the provisions in question shall apply with such modification or variation as may be necessary to make it valid.
24.This repair order shall be governed by and construed in accordance with the laws of Hong Kong. The Customer and YING FUNG hereby irrevocably submit to the non-exclusive jurisdiction of the courts of Hong Kong.
Remarks:
1. The on-site service fee does not include labour, parts, transportation and workshop service fee, while will be charged additionally.
2. Paid by cash to YING FUNG representative while each service is completed. Receipt will be issued at the same time in general.
3. On-site service in outlying islands, restricted areas and remote location requires longer time to arrange and additional fee will be charged, however, the service for far remote location may not be provided.
4. Customers in Discovery Bay shall pay the Discovery Bay Tunnel Access and Road Usage Fee.
5. Replaces part(s) shall be guaranteed for 30 to 180 days according to the service completion date.
6. If the case needs one more technician to move and check the machine, then will charge $250 per one machine. Included situation and/or: wall hanging, already-stacked machine, raise the washing machine's height by about 12 to 15 inches.
7. If the machine was placed at a ship or ferry, then will charge $500 for extra transportation fee.
